Terms of Service

These Terms govern your use of Markspeed’s website and diagnostic services. By accessing markspeed.ai or purchasing any service, you agree to these Terms. Please read them carefully.
1. Services
Markspeed provides B2B growth diagnostics and consulting services, including:
- GSRI Quick Scan — a free 16-question diagnostic tool that scores your growth system across 6 dimensions
- Growth Readiness Audit — a paid diagnostic engagement ($1,500 USD) that includes a full report, Financial Opportunity Model, 90-day roadmap, and 45-minute strategy session
- Growth OS Installation — a paid system implementation engagement ($9,500 USD)
- Growth OS Evolution — an annual growth retainer ($36,000 USD/year)

2. Eligibility
Our services are intended for business use only. By using our services, you represent that:
- You are at least 18 years old
- You are using the services on behalf of a business, not as a consumer
- You have the authority to enter into these Terms on behalf of your organization
- Your use complies with all applicable laws and regulations
3. Purchases and Payment
Paid services are invoiced and processed through Stripe or as otherwise communicated during the engagement process. By purchasing a paid service, you agree to:
- Provide accurate billing information
- Pay the applicable fees at the time of purchase or as invoiced
- Stripe’s terms of service as they apply to payment processing
Refund policy: Growth Readiness Audit ($1,500): if the diagnostic session has not yet taken place and no report has been delivered, a full refund may be requested within 48 hours of purchase. Once the report has been delivered or the session has occurred, no refund is available. Growth OS Installation and Evolution: governed by the engagement agreement signed at the time of purchase.
4. Deliverables and Intellectual Property
What you own: The diagnostic report, Financial Opportunity Model, and Notion Growth Roadmap delivered as part of your engagement are yours to use for your own business purposes.
What we retain: The GSRI™ framework, scoring methodology, benchmark database, diagnostic prompts, agent infrastructure, and all underlying intellectual property remain the exclusive property of Markspeed. You may not reproduce, distribute, license, or create derivative works based on the GSRI™ framework or any Markspeed proprietary methodology without written permission.
Benchmark data: Anonymized, aggregated data from your engagement may be incorporated into the Markspeed GSRI Benchmark Database as described in our Privacy Policy. This data is used to improve diagnostic accuracy and generate benchmark comparisons for other clients. No personally identifiable information is retained in the benchmark database.
5. Confidentiality
We treat all information you share during an engagement as confidential. We will not disclose your company-specific information (name, financials, team structure, strategic details) to third parties, except as necessary to deliver the service (e.g., scheduling via Calendly, report delivery via email) or as required by law.
We ask that you treat the GSRI™ methodology, scoring structure, and any proprietary diagnostic materials shared with you as confidential and not disclose them publicly or to competitors of Markspeed.
6. Disclaimer of Warranties
Our diagnostic services are provided “as is” and are based on the information you provide during the intake process. Markspeed makes no warranty that:
- The diagnostic output will identify every growth constraint affecting your business
- Implementing the recommended actions will produce any specific financial outcome
- The benchmark data is accurate for every industry segment or geography
The GSRI™ diagnostic is an analytical tool, not a guarantee of results. Business outcomes depend on implementation, market conditions, team execution, and factors outside our control.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Markspeed’s total liability for any claim arising from your use of our services shall not exceed the total amount you paid for the specific service giving rise to the claim in the 12 months preceding the claim.
In no event shall Markspeed be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of business opportunity, even if advised of the possibility of such damages.
8. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose
- Attempt to reverse-engineer the GSRI™ scoring methodology
- Resell, sublicense, or commercially exploit our diagnostic reports or methodology without written permission
- Submit false or misleading information in the diagnostic intake
- Interfere with the operation of our website or services
9. Governing Law
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the courts of British Columbia, Canada.
If you are located in the United States, you agree that any dispute will first be subject to good-faith negotiation before proceeding to formal legal proceedings.
10. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
